• "Services" means the legal services described on this website, including Will and Estate Consultation, Probate and Estate Administration, and Contested Inheritance Assistance.
• "User" / "you" / "your" means any individual who accesses this website or engages the Firm's services.

• "Retainer Agreement" means any written engagement letter or fee agreement entered into between the Firm and a client.

Delima Guaman provides legal services in the following areas:

Our services are available to clients located in Malaysia. The Firm operates primarily within the jurisdiction of Peninsular Malaysia and the courts of Kuala Lumpur and Selangor, though matters in other states may be accepted at the Firm's discretion.

Information provided on this Website is general in nature and does not constitute legal advice. A formal lawyer-client relationship is only established upon the signing of a Retainer Agreement.

When you submit an enquiry through this Website, you agree to:

Where the Firm is engaged to provide Services under a Retainer Agreement, the following terms apply:

• Scope: The scope of services is as agreed in the Retainer Agreement. Any changes to scope are agreed in writing before additional work commences.
• Client obligations: You agree to provide all information, documents, and instructions reasonably required by the Firm in a timely manner. Delays caused by incomplete or late instructions may affect the timeline of your matter.
• Timelines: Timelines for legal matters are estimates only. They may be affected by court scheduling, the conduct of third parties, the availability of government authorities, or other factors outside the Firm's control.
• Confidentiality: The Firm will maintain strict confidentiality over all information provided by clients, subject to any mandatory disclosure obligations under Malaysian law.

Our professional fees are as stated on this Website and in any Retainer Agreement issued to you. All fees are in Malaysian Ringgit (RM).

• Professional fees are payable as agreed in the Retainer Agreement, typically on commencement of services or in stages
• Disbursements (court filing fees, stamp duties, search fees, and similar government charges) are billed separately and are payable on request
• Accepted payment methods include cash, bank transfer, and online transfer to the Firm's client account
• Fees paid for completed work are generally non-refundable. Where work has not commenced or has been partially completed, a partial refund may be considered at the Firm's discretion

The Firm reserves the right to suspend or terminate services where fees remain unpaid after reasonable notice.

All content on this Website — including text, design, logos, and layout — is owned by or licensed to Delima Guaman. You may not reproduce, distribute, or republish any part of this Website without our prior written consent.

Documents and advice produced by the Firm in the course of providing legal services to a client are the work product of the Firm. Clients are granted a non-exclusive licence to use such documents for the purposes for which they were prepared.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

Either party may terminate an engagement by written notice to the other, subject to any terms in the applicable Retainer Agreement. On termination:

• The client remains liable for all fees and disbursements incurred to the date of termination
• The Firm will provide the client with a copy of any documents and correspondence held on file, subject to payment of outstanding fees
• The Firm may terminate an engagement where a conflict of interest arises, where the client provides instructions that would require the Firm to breach its professional obligations, or for other good reason

Provisions of these Terms that are intended to survive termination (including confidentiality, intellectual property, and liability clauses) shall do so.

These Terms and any engagement with the Firm are governed by the laws of Malaysia. Any dispute arising out of or in connection with these Terms or any Services provided by the Firm shall first be referred to informal negotiation between the parties.

If informal resolution is not achieved within thirty (30) days, either party may refer the matter to a Malaysian court of competent jurisdiction. The parties submit to the exclusive jurisdiction of the courts of Malaysia, and specifically the courts in Kuala Lumpur, for any such proceedings.

The Legal Profession Act 1976 and the Bar Council Rulings govern the Firm's professional conduct. Complaints regarding professional conduct may be made to the Bar Council of Malaysia.

• Entire agreement: These Terms, together with any Retainer Agreement, constitute the entire agreement between the Firm and the client for the matters covered herein.
• Severability: If any provision of these Terms is found to be unenforceable, it shall be modified to the minimum extent necessary, and all remaining provisions shall continue in full force.
• Waiver: Failure by the Firm to enforce any provision of these Terms shall not constitute a waiver of the right to enforce it in future.
• Assignment: The client may not assign any rights or obligations under a Retainer Agreement without the Firm's prior written consent.
