Common Questions

Frequently Asked Questions

Plain answers to questions we hear most often from families dealing with estate matters in Malaysia.

Do I need a lawyer to write a Will in Malaysia?
You are not legally required to use a lawyer, but a properly drafted Will — prepared and witnessed correctly — reduces the chance of disputes and delays later. Our consultation walks you through the requirements so your Will is clear and properly executed.
How long does the probate process typically take in Malaysia?
Timelines vary depending on the complexity of the estate and the specific court. A straightforward application may proceed in a matter of months, while more involved estates can take longer. We keep you updated at each stage and handle follow-ups with the relevant offices on your behalf.
What documents do I need to bring for an estate consultation?
Bringing the deceased's MyKad or passport, the death certificate, a list of known assets and liabilities, and any existing Will (if present) is a good start. If you are coming to plan your own Will, your identification and a general outline of your assets are sufficient. We will guide you through anything else needed as the matter progresses.
Can Delima Guaman assist with contested estate matters between siblings?
Yes. We work with families where disagreements have arisen over the distribution of an estate. Our approach is to seek an amicable resolution first through negotiation, and we proceed to formal representation before the relevant authority if that becomes necessary.
Are the fees quoted the full amount, or are there additional costs?
The fees listed cover professional fees for our services. Court filing fees, stamp duties, and similar disbursements charged by government authorities are separate and will be communicated clearly before any work proceeds. There are no hidden professional charges.
Is my information kept confidential?
All information you share with us is protected by legal professional privilege and our strict duty of confidentiality. Details of your estate and family circumstances will not be shared with anyone outside the firm without your express consent.
